Conditions of Participation

1. Scope

These conditions of participation apply to participation in the competition of AstorMueller AG Chamerstraße 50, 6331 Hünenberg, Switzerland, (here in after AstorMueller AG) in the period from September 28, 2022, to November 14, 2022.

The prizes advertised are: 70e-scooters -brand Kumpan model 54 Inspire 45 km/h incl. 1 battery.8 Dream vacationsworth € 8000 each. All participants have a double chance of winning:10 e-scooters and the 8 Dream vacationswill be drawn among all participants from all participating countries, another 60 e-scooters will be drawnlocally in the participating countries. The local drawnis based on the postal code and country code of the participant given upon registration. The assignment of the participant to the respective local drawnis carried out by AstorMueller AG based on the postal code and the country code according to a key that was already determined before the start of the drawn. Entrants who do not provide a zip codeand/or country code will not be able to enter the local draw.By entering the competition, the participant accepts the conditions of participation.The conditions of participation are available on the BAGATT brand website www.bagatt.comand can be printed out by the participant.

2. Eligibility

All persons who have reached the age of 18 are eligible to participate. By participating and registering online, the participant confirms that all the information provided is correct. Employees of AstorMueller AG and their family and household members are not eligible to participate. Participation takes place through the corresponding online registration. Correct and complete details of the data requested in the registration process must be entered in the respective free fields. First and last name, e-mail address and telephone number are required. To take part in the local lottery, the country code and the postal code of the home address must also be given. Participation is free of charge and can be taken during the competition phase (execution period is September 28th, 2022, to October31st, 2022) take place. The participant may only participate in his own name. Each participant may only participate once. Multiple participations lead to the disqualification of the lottery participants. Automated participation, entering incorrect data and technical manipulation also lead to direct exclusion from the competition. In the event of non-compliance with the conditions of participation, AstorMueller AG reserves the right to exclude the participant.

3. Discontinuation or Modification of the Contest

If the competition and/or the draw can no longer be continued for legal, administrative, or technical reasons in the event of unforeseen circumstances, AstorMueller AG can suspend or end this at any time without giving reasons. Unforeseen circumstances within the meaning of this provision may be manipulations, failure of hardware or software, program errors, computer viruses, mechanical, technical, or legal problems as well as external interventions by third parties. In this case, AstorMueller AG can change the conditions of participation at any time for the future. Participation that has already taken place remains unaffected. Participants will be informed of the changes in a good time. In the yearthe legal process is excluded.

4. Advertising Consent

By confirming in the additional field provided for this purpose, the participant agrees that his data may be used for marketing purposes by AstorMueller AG and its brands (bugatti, Daniel Hechter, BAGATT) and that the data may be used to enable marketing purposes (newsletter, no phone calls). The data for participation in the competition will be deleted by AstorMueller AG within 60 days at the latest after the competition has ended. Data for marketing purposes can be used beyond this date if consent has been given in a separate field. Participants can revoke this consent at any time with effect for the future (e.g., by unsubscribing from the newsletter). Likewise, a participant can revoke his consent at any time by sending amailto: marketing@astormueller.com.

5. Winner

Determination/Notification/The prizes shown on the website will be distributed among all eligible participants after the contestcampaign (period from September 28 to October 31, 2022). AstorMueller AG will draw the winners using a computer-assisted process. In the case of questionsregarding interpretation or disputes of any kind, the decision of the management of AstorMueller AG is to be regarded as final. The legal process is excluded. No correspondence will be entered into regarding the draw. Winners will be notified either by email or by phone. If notification of the prize is undeliverable or no response from the winner within 72 hours of notification, the prize will be drawn again. Prizes are non-cash, non-refundable, and non-exchangeable. Non-cash prizes will be sent to the address given during registration. Winners are responsible for paying any applicable taxes. By participating in this competition, the participant also allows AstorMueller AG to publish their abbreviated name and place of residence on the competition page if the participant wins.

6. Forfeiture of the right to the prize

If it is not possible to distribute a prize to a winner determined in the drawing because notification of the prize is not possible within 72 hours or the delivery of the prize fails and the latter cannot be made up for within one month of the drawing, the entitlement to the prize will be forfeited. The same applies if it only emerges after the drawing that a winner was excluded from participation or the conditions for exclusion are or were present.

7.Privacy Policy

The data provided by the participant will be used to process the competition and, if consent is given, to carry out the specified marketing measures. The data is processed in accordance with Swiss data protection law. Should stricter data protection rules apply to participants residing outside of Switzerland, these will apply. 8.Invalidity of individual clauses

Should a clause in these Conditions of Participation be ineffective, the statutory regulation shall take its place. The effectiveness of the remaining clauses remains unaffected.

9. Disclaimer

AstorMueller AG is not liable for data loss, technical defects or lost or late submissions due to network, hardware, or software problems. Any warranty claims against AstorMueller AG are excluded.

10. Governing Law

Swiss law applies to these conditions of participation. This choice of law does not affect the validity of mandatory consumer protection regulations that would apply in favor of the participant without this choice of law clause.
